If mediation is unsuccessful, the dispute shall be finally resolved by arbitration administered by the Dubai International Arbitration Centre (DIAC) in accordance with its Arbitration Rules. The seat of arbitration shall be Dubai, UAE. The language of the arbitration shall be English. The arbitral award shall be final and binding on both parties.

13.3 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in the courts of Dubai, UAE, to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
